Why aren't the records accurate on the Rothman portal?

I brought the MRI DISC from penn clearly showed misplacement of left hip prosthesist which is 50 degrees out  creating femoral anteversion that I never had prior to the surgery that you & Dr Nazarian did to me according to the records you were there that day although I never saw you once. 


This is criminal @ best to leave a patient like this with no concern whatsoever!!  I am suffering daily morning noon & night. My life has been completely turned inside out & upside down.  


Please add this letter to my chart. You were absent @ last appointment just like you were the day of my surgery when I was left with   inadequate treatment from such an incompetent group in Bensalem that day!! 


They took me into   the O.R. in tears because of their lack of empathy & total lack of skills or concern for the patient approaching major surgery because they weren't even  trained. It was unbelievable. 


The lack of empathy and incompetence displayed by the medical staff during my pre-surgery experience in the operating room was deeply troubling. Their lack of integrity and empathy combined with the apparent disregard for my well-being, is unacceptable in any medical setting & especially when I was facing a MAJOR SURGICAL PROCEDURE. 


Their failure to demonstrate basic skills and concern for a patient about to undergo major surgery is a serious issue that cannot be overlooked. The lack of empathy and competence in healthcare providers can have detrimental effects on patient outcomes and overall trust in the medical system. I deserved to feel supported, informed, and cared for throughout my  medical journey, particularly during critical moments such as preparing for major surgery.


In light of this distressing incident, it is crucial for your medical institution to reevaluate your   protocols to ensure that all staff members possess the necessary skills and empathy to provide high-quality care. Patients should never have to endure such emotional distress and lack of support when entrusting their well-being to healthcare professionals. It is essential that medical providers prioritize empathy, competence, and patient-centered care to uphold the highest standards of healthcare. But it didn't happen that day : October 14, 2022 in Bensalem PA. 


The people who prepped me for surgery weren't even nurses; they were medicalassistants@ best & their main priority was getting out of there that day being it was Friday.  That is below the standard of care promised to me as a patient. Nancy threw the papers at me & couldn't even look me in the eye ; they were so mean to me it was unreal.  They treat the dogs @ the SPCA better than I was treated. I felt like more of an inconvenience rather than a priority that day. Dr Nazarian should have rescheduled the surgery seeing how upset I was after all of the mistreatment I experienced before being taken into the O.R. He obviously didn't look out for my welfare either to leave me at the hands of that team & the anesthesiologist was a complete moron making stupid jokes rather than assuring the patient they were in good hands. Looking back now I see I wasn't in good hands; the outcome is obvious & tragic. 


I think its time Dr Nazarian retires instead of hurting any more innocent people like me whose only crime was trusting people like you.

I've been requesting the IMPLANT STICKER But to date haven't received even a call back or email from you except for the time Dr Nazarian called me SCREAMING AND YELLING @ me after you showed him this letter. Nazarian said he didn't care & said " I'm not gonna do anything"  even though the imaging  tells the story of his misplacing  the hip implant being 52 degrees out & normal range is 20 degrees. The Doctor in New York  @ HSS said Rothman owes me to take care of it but clearly Nazarian doesn't care about my mobility,  lifestyle or anyone since he's willing to just be so indifferent & smug . Maybe its time Dr Nazarian hangs up his scalpel & retire before he hurts anyone else & destroys their life

ETHICAL CHALLENGES 

WHEN MONEY TALKS

Abstract

Despite our recent attention to ethical issues in orthopedics, we are still faced with multiple conflicts of interest that continue to pose ethical dilemmas to the practicing physician. Using four case scenarios, we review the potential conflicts of interest and the dilemmas posed by these frequently encountered situations. The ethical conflicts confronted in resident training, the introduction of new technology, physician advertising, and the obligations of the sports team physician are reviewed and discussed. The basic principles of medical ethics, including acting for the good of the patients and doing no harm, are discussed in the context of the four case scenarios.

Introduction

Because of our training and expertise, physicians are permitted to do things to people that, if performed by anyone else, could be considered felonious assault. Through our contract with society, physicians have been granted the privilege to interact with individuals in ways that no other citizens can [12]. On any given day, doctors routinely invade people’s private lives, ask them decidedly personal questions, touch them, manipulate their extremities, expose them to radiation, inject them with potential toxins, prescribe them harmful chemicals, and even cut into their bodies. Ironically, when we are done, most people thank us for the incursion.

Significant obligations come with these privileges. We are obligated, as physicians, to use our knowledge of science and medicine to act for the good of our patients. We have a fiduciary responsibility, from the Latin fiducia, meaning trust, to place our patients’ interests above all others, including our own. It is our obligation as physicians to hold our patients’ interests and well-being as paramount [34].

In addition, we are bound, not only by the ethical principle of non-maleficence, namely, to do no harm, but as physicians, we must go further. We are obligated to act for the good of our patients, fulfilling the ethical principle of beneficence. Avoiding patient harm is not sufficient; we, as physicians, must actively seek to do good for others. And because our actions as physicians can have such drastic consequences upon peoples’ lives, everything we do to our patients and for our patients, falls under the domain of medical ethics.

This manuscript reviews four topics in medical ethics that have become especially interesting to the orthopedic surgeon. As orthopedic surgeons, we utilize more technology, more implantable devices, more industry support, and more mechanical innovations than any other branch of medicine. We are, therefore, exposed to the particular ethical issues and implications pertaining to the technological advances of this new technology. Because we are the clinicians primarily responsible for caring for athletes at all levels of play from young adolescent to paid professional, we must confront the unique ethical issues of balancing the often conflicting desires of the athlete, coaches, owner, school authorities, parents, and physician. As a profession, our orthopedics academy has taken the leadership role in recognizing the potential conflicts of interest that exist in physician marketing and advertising. And because orthopedic surgeons have placed such an emphasis on advancing medical education and orthopedic expertise, we again must be vigilant in balancing our obligation to patient safety and care and our obligation advance our learning.

Ethical issues in resident training, the use of new technology, physician advertising, and the role of sports team physician persist. As always, a critical analysis of these issues will be elucidating, and hopefully, promote additional questions and discussion.

Resident training

A PGY 4 orthopedic resident is first assisting on a total hip replacement. Having assisted the attending physician on many occasions, the attending allows the resident to prepare the femur. The resident reams the femoral canal appropriately. Upon broaching the canal with the femoral trail broaches, the proximal femur is fractured necessitating fixation of the fracture and conversion to a long stem prosthesis.

One of the central tenets of medical ethics that is repeatedly emphasized in the ethics literature is the physician’s obligation to “act for the good of the patient”. However, whenever a resident at the beginning of a learning curve performs a procedure that could have been performed better by a more experienced surgeon, both the teacher and learner are not acting for the good of the patient. In the above scenario, the patient required a more extensive surgical procedure, likely requiring additional anesthesia, incurring a greater blood loss, and necessitating a more complex prosthesis. The patient was subjected to greater risk, discomfort, and potential complications violating the medical dictum of “do no harm.”

Additionally, respect for a patient’s autonomy requires that patients be informed of their role in the teaching process. It is essential that patients be made aware of the presence of residents in the operating room, the extent of resident involvement in their case, and the level of experience of the resident. Patients must be allowed to make informed decisions regarding their participation in the medical education process.

So why would patients subject themselves to the potential of additional harm or discomfort? Because reasonable people understand that continuing medical education is essential for having trained physicians available to their community. Everyone would like only the most experienced surgeon to perform their surgery, only the most knowledgeable clinician to care for them. At the same time, people realize that additional physicians must continually be trained and that patient involvement is an integral part of that training. Because that training is necessary, and because the opportunity to learn on patients is essential to that learning, and because the differences between us are not so significant as to excuse anyone from doing a fair share in that training, every patient has an obligation to participate in the medical education of our future physicians [56•, 7•].

Consequently, supervising physicians have an obligation to ensure that medical training programs are carefully designed and appropriately supervised to minimize risks and harms to patients. Medical students and resident candidates must be carefully selected. Surgical education must remain a rigorous, sequentially organized, and vigilantly monitored. Invasive procedures should be carefully designed and supervised to protect patients. Every conceivable measure must be instituted to maximize the resident’s training while minimizing the risk of injury to the patient.

These same issues must also be considered by established surgeons learning new techniques. Those physicians are similarly at the beginning of a learning curve where the risk to the patient is greater than with a clinician of more experience. In those situations, patients must be informed as to the surgeon’s experience with the proposed procedure, the level of supervision available, and the potential additional risks incurred by an inexperienced surgeon. Likewise, everything possible should be done to minimize the patient’s risk while the surgeon is still mastering a new technique, approach, procedure, or device.

The key elements of ethical behavior regarding medical training are informing the patient of the involvement of trainees and their role in the patient’s care, and establishing strict procedures and criteria to minimize patient’s risk. Instructors must inform patients of the resident’s role in their care, and the potential additional risks and benefits that participation may incur. Similarly, surgeons who are themselves at the beginning of a learning curve should inform their patients of the status of that surgeon’s level of expertise and the alternatives available to the patient should they chose not to participate in the learning process.

New technology

A biomedical manufacturer has developed new acrylic bone cement that polymerizes rapidly when exposed to the current from an electrocautery device. The cement is reported to save a significant amount of operating time by allowing a rapid set time once the implants have been positioned. Surgeons quickly embrace the new cement product. Within 1 year of the cement’s release, multiple centers report radiographic evidence of cement fragmentation.

The introduction of any new technology, device, implant, or surgical technique raises a myriad of ethical issues. New technology, by its very nature, is typically untested and unproven in large patient groups. Most new technology is released to physicians and used on the general public after nominal testing and limited clinical trials. Potential complications can go unrecognized for years and may come to light only after large numbers of cases have been performed [811]. So why embrace unproven technology and what are the ethical consequences and obligations of doing so?

There are many reasons for adopting innovative technology. New devices or innovative surgical techniques may fill a void in our armamentarium of patient care options. New technology may address a problem that was previously unsolvable or may improve upon an existing treatment modality that had previously been ineffective or incomplete. But clinicians must be cognizant of other reasons for adopting new technology that may have more to do with the clinician’s self-interest or pressure from patients. Before embracing new technology, orthopedic surgeons must carefully examine our reasons for utilizing unproven modes of treatment with the potential for substantial risks to the patient.

Many patients, as well as their physicians, want what is new. People often equate new with better, new with improved, and new with the latest technological advances. Patients frequently present to our offices with internet articles, advertisements, and publications in hand, touting the newest technologies in our field. Understandably, patients always want the best, and they imagine that anything newer is better. Likewise, physicians want to be on the cutting edge of new technology. Using new devices or learning new techniques can be exciting. Performing the same operation day in and day out can become boring, while trying new technology can be stimulating.

Also, being the first one on the block to offer new technology can be a powerful marketing tool. Patients want their doctors to be current and offer the newest advances and techniques. These dynamics motivate some physicians to introduce new techniques before they are adequately proven sometimes merely as marketing gimmicks. Minimally invasive surgery platelet-rich plasma, anterior approach to the hip has been touted as being safer, better, and more effective than more traditional modalities, even though much of the literature has demonstrated uncertain or conflicting results. Whereas patients equate new with better, every practicing physician has seen the catastrophic outcomes that can occur with unproven devices, techniques, or medications.

When new technology is released for general use, that release is often based upon the experience of a few investigating specialists. Often, those initial investigators have dedicated enormous amounts of time and efforts to developing expertise with the new technology. Once the technology is released for general use, however, the clinical outcomes may be vastly different from those reported by the investigative group. The training required to begin using new technology can range from tightly regulated instructional programs, to self-instruction articles, to technique videos. Likewise, clinicians utilizing new technology may come from a highly variable experience pool. Surgeons’ experiences, skills, and styles vary widely. Such differences explain why complications that are not identified within the small investigative sample may arise when the innovations are adopted by a large number of clinicians.

Additionally, there is always a learning curve with any new technology [12•]. Even with minor alterations of devices, there is some new learning that needs to occur. Obviously, more complex procedures, approaches, or devices take longer to master. Also, surgeons bring their own experiences and expertise to the table. An experienced arthroscopist may take very little time to learn a new arthroscopic technique, whereas, an experienced joint surgeon who performs relatively few arthroscopic procedures may take much longer. Surgical hubris must also be factored into the learning curve. Some surgeons feel comfortable even after observing a single case, whereas others may not feel ready even after multiple supervised procedures. Adequate preparedness cannot simply be a matter of the surgeon’s comfort as this may reflect ego and eagerness rather than surgical skill. For all of these reasons, the profession should consider the circumstances that justify expanding requirements for certification of clinician competency and credentialing before surgeons are allowed to apply new challenging and dangerous techniques.

The introduction of new technology requires close monitoring. The clinical outcomes in a small study group may be vastly different from the results in the general population. Low incidence problems may not present themselves until large numbers of cases have been performed. Likewise, some very serious complications may not become evident until several years after the index procedure or treatment. We have previously made the case for a joint registry for these very same reasons [13]. Several severe and catastrophic device complications were quickly detected in countries with mandatory registries. These same complications have taken much longer to detect in the US, to the detriment of many patients, because our orthopedic community relied solely upon individual site reports.

Again, patients must be honestly informed as to the extent of a surgeons experience with a planned procedure that uses new technology. Obviously minor alterations in a well-established procedure or in a commonplace device may not warrant an extensive explanation. Using any new or unproven procedure, approach, or device that involves inherent additional risks related to its novelty, should be fully explained to the patient, as should information on a surgeon’s initial steps onto a learning curve. A forthright approach reflects the ethical standards expected for truly informed consent.

When Choosing a Doctor

When selecting an orthopedic surgeon for a hip or knee replacement, it is imperative to engage  your own research,  forward-thinking. and current living situation.  In order to ensure long-term success and optimal outcomes, patients should consider several  key factors. Firstly, inquire about the surgeon's experience and specialization in joint replacement surgeries.  A surgeon with a focus on orthopedic procedures is more likely to possess the expertise required for a successful operation. And don't forget that a lot of the young superstars use the robotic computer robotics to assist in 1st time hip or knee replacements after the 1st surgery the doctors cannot use the robotic assist in follow up revisions if the 1st surgery did not go as planned or you were told..  I'd say that skills are even more important to the patients outcome & future than bedside manner since you only see the doctor @ follow up visits.  You need to  do your own research prior & have your questions & concerns written on an index card. Don't take it personally if the doctor seems busy because they are incredibly busy people & doing their level best to help many many people with variety of problems day in and day out. Most doctors genuinely want to help you. 


Secondly, it is essential to ask about the hospital or surgical center where the procedure will take place. Inquire about the facility's infection rates, accreditation, and overall reputation for orthopedic surgeries. Choosing a reputable institution with a track record of successful joint replacements can significantly impact the outcome of the surgery.  From my experience I do not recommend going to a surgery center because the standard of care is much much lower than a hospital; leaving staff to cut corners etc etc. For example in a surgery center they may not use an R.N. and use medical assistants at best & they are light years away from a Registered Nurse. 


Lastly, do not hesitate to discuss the surgeon's approach to post-operative care and rehabilitation. Understanding the recovery process and the surgeon's recommendations for physical therapy and follow-up appointments is crucial for a smooth and successful recovery. By asking these questions and prioritizing forward-thinking, patients can make informed decisions when selecting an orthopedic surgeon for hip or knee replacement surgery.  Don't go to any place with a solo practice because they can change records & do what they want with no real accountability.

Robotics & Orthopedic Surgery

Orthopedic surgery, like any field of medicine, has historically been susceptible to errors and complications. In the past & even now in 2025 mistakes are sometimes swept under the rug; records re-written and hidden from the patients and public scrutiny. However, the increasing adoption of advanced robotic systems is ushering in a new era of transparency, precision, and patient safety.  There is becoming less room for error and also an increase in transparency and accountability.   But remember the robotic equipment is only good for those that are adept at using it.  Be sure to inquire about it before going into the operating room. 


Traditionally, orthopedic surgeons relied on their extensive training and experience to perform complex procedures like joint replacements and spinal fusions. While most surgeries were successful, the inherent variability in human judgment and technique occasionally led to suboptimal outcomes. Implants might be positioned slightly askew, or soft tissue could be inadvertently damaged. In some cases, these mistakes were downplayed or even concealed, eroding trust between doctors and patients.


The rise of robotic-assisted surgery is transforming this landscape. Sophisticated systems equipped with 3D imaging, real-time navigation, and miniaturized instruments are enabling surgeons to perform operations with unprecedented accuracy and consistency. These robots don't get tired or shake like human hands might, allowing for more precise dissections and placements of implants which is critical for optimal outcomes & the patients' quality of life.


One of the most significant advantages of robotic systems is the wealth of data they capture before, during, and after surgery. This information promotes transparency, as every detail of the procedure is documented and analyzable. Any deviations from the pre-operative plan or minor complications are automatically recorded, leaving no room for errors to be hidden. This level of accountability is a game-changer for patient safety and trust.


But the key to unlocking the potential of these robots lies in the hands of the surgeons and their support teams. Proficiency with the complex software and hardware is crucial for optimal results. Manufacturers are investing heavily in training programs, and many surgeons are dedicating hundreds of hours to mastering these cutting-edge tools.


The partnership between well-versed surgeons and advanced robots is already yielding remarkable outcomes in most cases. Studies are showing reduced complication rates, less postoperative pain, and faster recoveries compared to traditional open techniques. As the technology continues to evolve, we can expect to see even more personalized care, with robots tailored to address specific musculoskeletal conditions.


Orthopedic surgery is undoubtedly entering a golden age, with robots and human surgeons working side by side to deliver the best possible outcomes. The days of hidden mistakes are fading, replaced by an era of transparency, precision, and data-driven excellence. As patients, we should welcome our new robotic colleagues, recognizing that they're not here to replace our skilled surgeons, but to enhance their abilities and our collective wellbeing.


The future of orthopedics is robotic, and that's something to be excited about. With the right training and mindset, these machines will become indispensable tools in our quest for optimal musculoskeletal health.  So, the next time you or a loved one faces the prospect of surgery, remember – a robot might just be your best ally on the road to recovery.  But also keep in mind that it is good to come equipped with a list of questions expecting answers from your orthopedic doctor to see if his level of expertise is consistent with the outcome you are being promised and the results you are after before going with a surgeon.  Often a doctor will list on their online resume that they use robotics only to find out later that they did not use it during your particular surgery.   Thats not good and by law the doctor then may not accept any accountability for his negligent actions thereby trying to put the onus on the patient who was unconscious at the time of surgery which is almost delusional for example it happened to me @ Rothman Orthopedic Hospital in Bensalem under the care of Dr. David Nazarian who displayed on his resume that he uses the Mako Robot ; why didn't he use it that day?  He did me & how many countless others a total dis-service.  His indifference is totally callous and zero accountability like several other medical professionals like Dr. Lenwood Nelson who promised to do my surgery in 2020 but obviously used the interns to increase financial gain at the University of Pennsylvania Presbyterian Hospital from the  HUP  with absolutely no discussion therefore not total transparency in the Doctor/patient relationship.  Thats not fair or ethical to me.  How can you do that to a person?  There is so much of this going on today especially in teaching hospitals and after seeing Dr. Nelson he threw his hands up yelling @ me I'm done, Im done Im done!!  He really was so cold and indifferent about what they had done to my body.  To be honest I couldn't believe it myself because I thought he was a fine doctor but after that day and the outcome I really changed my opinion of him as a person and man.  

But I do not think this happens with most doctors unless they are rather old and refusing to retire in spite of any bad outcomes and the impact that it has on a person's quality of life.  Personally I believe most doctors are incredibly compassionate humanitarians that earnestly use their gifts and talents to uplift the whole of humanity and within the scope of orthopedics to enhance the quality of life for individuals which ripples out affecting society on so many levels.  And yet there are some older doctors that would better serve the public to pass the Torch on to the more qualified next generation who are better trained with robotics.

Shifting Priorities

In the realm of medicine, particularly within the field of orthopedics, a concerning shift has taken place. The once noble profession has succumbed to the pressures of corporate interests, with a primary focus on maximizing profits. Regrettably, patient care has been relegated to a secondary priority, especially evident in the oversight of pre-operative, intra-operative, and post-operative care, particularly when complications arise.


This trend towards prioritizing financial gains over patient well-being is alarming. The ethos of medicine, centered on compassion and healing, has been overshadowed by profit margins and business strategies. The unfortunate consequence is a system where the welfare of patients is compromised, as doctors may neglect comprehensive care in favor of expediency and cost-efficiency.


It is imperative that a reevaluation of priorities occurs within the orthopedic field and the broader medical community. Patient care must reclaim its position as the cornerstone of medical practice, with meticulous attention given to every stage of treatment. Only through a concerted effort to refocus on the well-being of patients can the integrity and effectiveness of medical care be restored.

Malpractice in America

Does a fisherman sell bad fish?  Suing a surgeon for malpractice can be almost impossible because of the law covers their mistakes plus they have a lot of lawyers to protect their 1/2 truths & some others are just blaring lies.  O.k. the complexity of Malpractice Claims: Medical malpractice claims are complex and require the plaintiff to demonstrate that the doctor's actions deviated from the accepted standard of care, which can be difficult to prove  Why is that you say? 

1.Burden of Proof

In a medical malpractice lawsuit, the plaintiff has the burden of proving their case by a preponderance of the evidence, which means demonstrating that it is more likely than not that the defendant is liable for damages

2. Expert Testimony: Proving malpractice often requires hiring expert witnesses who can testify about the doctor's negligence and the standard of care that should have been followed3.Statute of Limitations: There is a time limit for filing a medical malpractice lawsuit, which can vary by state but is typically around 2 to 3 years from the date of the injury Or discovery. 

4. Defenses: Doctors and hospitals may have defenses available, such as claiming that the patient had a pre-existing condition or that the outcome of the surgery would have been the same even without their actions or empty promises @ other times.  

5. Emotional and Financial Toll: Pursuing a malpractice claim can be emotionally and financially draining, with legal fees and the need to present a compelling case1.These factors contribute to the difficulty of suing a surgeon even when there is clear evidence of wrongdoing.
